Abstract
Background: With the increasing globalization of businesses and individuals, cross-border insurance claims have become more prevalent. However, varying national legal frameworks create significant challenges for insurers and policyholders alike.
Objectives: This study aims to analyze the legal challenges in cross-border insurance claims, focusing on jurisdictional conflicts, regulatory inconsistencies, and enforcement difficulties.
Methodology: The study adopts a comparative legal approach, reviewing case laws and regulatory frameworks from major jurisdictions, including the United States, European Union, and China.
Findings: The research identifies key legal obstacles in international insurance claims, including conflicts of law, lack of uniform regulations, and enforcement barriers. It suggests a need for greater harmonization through international treaties and cooperation among regulatory bodies.
