Abstract

Background: The growth of cross-border insurance in South America is driven by increasing regional trade and economic integration. However, divergent regulatory frameworks and inconsistent enforcement mechanisms create barriers to effective implementation and consumer protection. Harmonizing these frameworks is essential to ensure seamless operations and equitable access across borders.


Objective: This study examines the challenges and opportunities in harmonizing regional frameworks for cross-border insurance in South America. It focuses on identifying gaps in current regulations and proposing pathways for legal and regulatory integration.


Methodology: A qualitative research approach was used, analyzing legal and regulatory frameworks in Brazil, Chile, and Colombia. Data was collected from policy documents, case studies, and interviews with regulators, insurers, and legal experts. The study also reviewed international best practices from other regions to identify transferable solutions.


Findings: The findings highlight significant regulatory disparities among the studied countries, particularly in areas such as data privacy, claims processing, and dispute resolution. While Brazil has implemented progressive cross-border insurance policies, Chile and Colombia face challenges in aligning their regulations with regional standards. The study emphasizes the importance of creating a regional regulatory body, streamlining compliance requirements, and fostering multilateral agreements to address cross-border risks. Recommendations include enhancing legal capacity-building programs, adopting uniform standards, and leveraging technology to improve transparency and efficiency.
