Cross-Border Insurance Claims: Legal Implications in the European Union and Africa

Abstract
Background: With increasing globalization, cross-border insurance claims have become a pressing issue for insurers and policyholders. Variations in legal frameworks across regions complicate claim settlement processes.
Objective: This study examines the legal challenges of cross-border insurance claims between the European Union and Africa, focusing on jurisdictional conflicts, enforcement of judgments, and regulatory inconsistencies.
Methodology: The research combines doctrinal analysis with interviews of insurance professionals and policyholders involved in cross-border disputes. Comparative case studies highlight practical challenges in claim resolution.
Findings: The study identifies significant gaps in harmonizing legal frameworks, particularly concerning jurisdiction and enforcement. While the EU benefits from uniform regulations like the Rome I Regulation, African countries rely on diverse national laws, creating procedural barriers. Establishing bilateral agreements and adopting model laws could streamline cross-border claims.
