Navigating Informal Economies: The Role of Insurance Law in Protecting Vulnerable Communities

Abstract

Background: Informal economies form a significant part of livelihoods in many developing regions, particularly in the African continent. However, individuals and small enterprises in these economies often lack access to formal insurance mechanisms, leaving them vulnerable to financial shocks. Evolving legal frameworks play a crucial role in bridging this gap by fostering accessible and equitable insurance solutions.


Objective: This study investigates the role of insurance law in addressing the needs of vulnerable communities operating within informal economies. It aims to identify the regulatory barriers and propose strategies to enhance legal protections for these underserved populations.


Methodology: A qualitative research approach was employed, focusing on case studies from Namibia, Senegal, and Malawi. Data was gathered through interviews with insurance regulators, legal practitioners, and informal economy participants. Policy documents, regional legislative texts, and reports from 2015 to 2024 were also analyzed. The study examines the interplay between formal legal frameworks and informal risk-sharing practices.


Findings: The research highlights a lack of inclusivity in existing insurance laws, which often fail to address the unique risks faced by informal economy participants. While Namibia has made progress with microinsurance regulations, countries like Senegal and Malawi struggle with enforcement and awareness challenges. Recommendations include integrating community-based insurance schemes within formal legal frameworks, streamlining registration processes, and enhancing legal literacy among vulnerable communities.
