Abstract

Background: Emerging markets face significant challenges in extending insurance coverage to underserved populations. Barriers such as affordability, lack of awareness, and regulatory inefficiencies hinder equitable access to insurance. Legal frameworks must evolve to foster inclusivity and address these gaps, particularly for marginalized communities.


Objective: This study explores legal pathways to create inclusive insurance systems in emerging markets. It focuses on identifying barriers to accessibility and equity and proposes actionable strategies to enhance the role of insurance law in bridging these gaps.


Methodology: The research adopts a mixed-methods approach, combining doctrinal analysis of insurance laws with field studies from Eswatini, Zambia, and Burkina Faso. Primary data was collected through interviews with stakeholders, including policymakers, legal experts, and community representatives. Secondary data included legal texts, policy reports, and comparative analyses of international best practices.


Findings: The study identifies significant gaps in regulatory frameworks that limit the reach of inclusive insurance. In Eswatini, for instance, high compliance costs deter microinsurance providers, while in Zambia and Burkina Faso, regulatory oversight and consumer protection mechanisms are underdeveloped. The research underscores the importance of simplifying regulatory processes, integrating community-based insurance schemes, and strengthening regional collaborations. Recommendations include capacity-building programs for regulators, legal incentives for insurers to serve low-income groups, and public awareness campaigns to promote insurance literacy.
