Abstract

Background: The dynamic landscape of insurance law in North America reflects evolving socio-economic conditions, technological advancements, and cross-border complexities. Addressing regulatory challenges is crucial to ensure consumer protection, equitable practices, and sustainable industry growth.


Objective: This study aims to analyze the current regulatory frameworks governing insurance law in North America, focusing on variations between Canada and the United States. It highlights emerging issues such as digital insurance platforms, data privacy, and cross-border risk management.


Methodology: The research adopts a qualitative approach, using a combination of legislative analysis, case studies, and expert interviews. Primary data is collected from industry professionals, while secondary data includes legislative documents, journal articles, and regulatory reports from 2020 to 2024. A comparative framework is applied to examine differences and similarities in regulatory practices between Canada and the United States.


Findings: The study reveals significant disparities in the treatment of digital insurance, with the United States adopting a more fragmented state-by-state approach compared to Canada’s centralized regulatory model. Key challenges include harmonizing cross-border policies, ensuring data security in digital platforms, and addressing consumer complaints effectively. Recommendations are provided to bridge regulatory gaps and enhance collaboration between nations to streamline insurance practices in the region.
