Abstract

Background: The insurance industry in the Asia-Pacific region is undergoing a significant transformation driven by digital advancements. This evolution has introduced new complexities, including cybersecurity risks, algorithmic accountability, and data privacy concerns, which demand robust legal and regulatory responses.

Objective: This study systematically reviews the existing literature on the intersection of digital transformation and insurance law in the Asia-Pacific region. The objective is to identify key themes, gaps, and future research directions in the regulation of digital insurance practices.

Methodology: A systematic literature review (SLR) methodology was adopted, analyzing peer-reviewed articles, policy documents, and industry reports published between 2010 and 2024. Databases such as Scopus, Web of Science, and JSTOR were searched using keywords related to digital insurance and regulatory challenges. Inclusion criteria focused on studies relevant to the Asia-Pacific region. The selected articles were critically analyzed and categorized into themes such as consumer protection, digital governance, and legal challenges.

Findings: The review identifies three major themes: the need for harmonized cross-border regulations, the importance of addressing algorithmic biases in digital insurance, and the growing emphasis on consumer-centric policies. It highlights significant research gaps, including the lack of studies on the legal implications of AI in insurance and the limited focus on low-income markets. The study concludes with recommendations for future research, emphasizing collaborative policy development and the integration of ethical considerations into regulatory frameworks.
