Abstract
Background: The rise of social media has revolutionized fraud investigation techniques, offering new avenues for collecting evidence and verifying claims. In the insurance sector, social media platforms are increasingly used to detect fraudulent activities, but their use raises significant legal and ethical concerns, particularly in Europe, where privacy regulations are stringent.
Objective: This study examines the role of social media in insurance fraud investigations across Europe, highlighting its potential benefits and legal challenges. It aims to analyze how social media evidence is utilized within the confines of European privacy laws and to propose a balanced framework for its ethical and legal use.
Methodology: The research employs a multi-method approach, combining case studies of fraud investigations in the United Kingdom, Germany, and Spain with interviews of insurance investigators and legal experts. A review of legal texts, including the General Data Protection Regulation (GDPR) and national laws, was conducted to assess the regulatory landscape.
Findings: The study finds that while social media can be a valuable tool in fraud detection, its use is often hindered by privacy concerns and inconsistent legal frameworks. The United Kingdom demonstrates proactive use of social media evidence, while Germany maintains stricter privacy safeguards. Spain faces challenges in balancing investigative efficiency with GDPR compliance. A harmonized European regulatory framework is needed to ensure the ethical and effective use of social media in fraud investigations.
