Abstract
Background: Insurance is a vital tool for improving healthcare access, but legal and regulatory challenges often hinder its effectiveness. The United States and India, with their vastly different healthcare systems, provide contrasting perspectives on the role of insurance.
Objective: This study investigates the legal frameworks governing healthcare insurance in the United States and India. It aims to identify challenges and propose reforms to enhance access to quality care.
Methodology: The research uses a comparative analysis of statutes, policies, and court decisions in both countries. Interviews with healthcare providers, insurers, and policyholders offer practical insights.
Findings: The United States struggles with affordability and fragmented regulations, despite comprehensive coverage under the Affordable Care Act. In India, a lack of mandatory health insurance and regulatory oversight limits accessibility. Both countries could benefit from policy innovations that prioritize affordability and transparency.
