The Role of Insurance in Protecting Intellectual Property: Legal Perspectives from South Korea and Germany
Main Article Content
Abstract
Background: The rising value of intellectual property (IP) in the global economy has necessitated the development of specialized insurance products to protect intangible assets. However, the legal frameworks governing IP insurance remain underexplored.
Objective: This study examines the role of insurance law in protecting intellectual property in South Korea and Germany. It focuses on the coverage scope, regulatory frameworks, and legal challenges in both countries.
Methodology: A comparative legal analysis of South Korea’s IP insurance policies and Germany’s established frameworks is conducted. The study also includes case studies of disputes involving IP insurance claims, supported by interviews with insurers and IP attorneys.
Findings: South Korea’s innovation-driven economy has spurred the growth of IP insurance, but regulatory ambiguities persist. Germany’s established frameworks provide greater clarity but are less flexible. Harmonizing global standards could enhance IP insurance’s role in fostering innovation and mitigating risks.
